It sounds like they could have set the apartment complex up better to handle situations like this, but 7 inches of rain in one hour is a lot unless you live in the middle of the Hawaiian island of Kauai. I’m betting the landlord would be able to successfully assert this incident as an Act of God in court. Your brother’s best bet is to try and make a claim on his renter’s insurance.
7 inches an hour is a lot, and your brother probably experiences a “flash flood”. This is when it rains so much in such a short amount of time that the storm drains get backed up and can’t drain the water away.
I’d call it an “act of God”. It’s very hard to plan for every little thing that could happen. And even if they could, it would be so expensive that your brother’s rent would be 10 times what it is now.
